All information and services offered by this site are available to all visitors conditioned that you agree to all terms, policies and conditions declared herein. Throughout these terms you will see the word "Service", implying and describing this website and any and all "products" (whether digital or physical) available by way of this website or ever offered to the public by CRM. It will not always be made apparent which should be taken into context so it is declared here to always consider both to be the definition of "Service". 

By conducting a purchase from CRM by way of this website or other means directly from CRM you agree to abide by all terms set forth by all declarations found on this site. (i.e, the terms of service and all policies).

As such you are bound under the Terms of Service ("Terms") (what you are reading) and all terms, policies, conditions and/or declarations found elsewhere on this site or available by hyperlink. (In the event these/that exists). These Terms apply to all users of this site regardless of the purpose of visitation.

This online store is hosted by Shopify inc, who provides the E-commerce platform for secure and reliable online retailing and enables us to offer you the highest grade online retail experience. 

Section 1 - Outline of Terms

By agreeing to these terms, you represent that you are at least the age of majority in the locale which you reside and/or that you have given minor dependents the permission to use this site.

You may not use any of our products for illegal or unauthorized purposes nor may you, in the use of a service violate any laws in your jurisdiction.

A violation of any of these Terms will result in the termination of your services and potentially legal action. 

Section 2 - Basic Conditions 

CRM reserves the right to refuse service to anyone for any reason at any time. CRM pledges to never transfer or sale any information of any account holder or patron to any third party. The only situation where any personal information may be transferred to a third party is in the event of a format of Governmental/law enforcement order.  

Section 3 - Optional Tools or Services

By using this site we may provide you with acess to third party tools over which we neither monitor nor have any input over. You agree that CRM provides access to such tools "as is" and "as available" without any warranties or conditions of any nature and without endorsement. CRM has no responsibility or liability whatsoever regarding or relating to your use of optional third party tools or services. 

Use of third party tools or services is entirely at your own risk and at your own discretion and you should make sure you agree to and are familiar with the respective Terms set by the relevant third party tool or service proprietor(s) and/or provider(s).

Section 4 - Billing, Contact and Account information

CRM has the right to refuse any order placed with us. We may in our sole discretion, limit or cancel quantities purchased per household, organization, or person per order or in general. These restrictions may apply to any method of association deemed by CRM, which may be: account, address, credit card or other means. We reserve the right to do this without contact of the patron who placed the order. We reserve the right to limit or prohibit orders which in our judgement may be placed by dealers, resellers or distributors. 

By placing an order with CRM you agree to provide current, complete, accurate and up to date information for all purchases. In the event of an order which will be fulfilled at a later date than the date of initial placement (such as a preorder), you agree to keep your account in good standing with accurate, relevant and up to date information. This will enable us to contact you as needed and complete the transaction(s) appropriately as needed. 

Section 5 - Services and Products where applicable

CRM may offer certain products or services exclusively online through our website. 

We reserve the right to limit sales or offering of a product or service to certain geographic regions or to a person/organization. 

All descriptions of products, parameters of product or pricing of a product may change at any time without notice. Any product may be discontinued at any time. In the event a product has been paid for in full yet an announcement of discontinuation or cancellation has been declared then the patron(s) who have posted payment will promptly receive a complete refund by form of initial payment or by way of check in the event initial payment form reimbursement is not possible. CRM would never raise the price of a product and charge a patron without notice. In the event a product has the price increased before fulfillment of order, all patrons who have posted payment will be contacted to with a request to complete the difference or completely cancel their order and receive a full refund by way of the previous statement herein. 

CRM reserves the right to modify or discontinue a service (or any aspect therein) without notice. CRM does not warrant that the quality of any information, product or service obtained by you will meet your personal or collective expectation(s), or that any errors in a service or statement will be corrected. 

Section 6 - Accuracy and/or Completeness of Information or Declarations

CRM cannot be and is not responsible if information available on this website is not accurate, complete or current. Material found on this site is provided for general information only and should not be relied upon or used as a sole basis for making decisions without consulting primary, more complete or more accurate information. Any reliance on the material on this site is at your own risk. 

Certain historical information may be contained on this site. Historical information is not current and is provided for your explicit reference only. The right is reserved by CRM to modify the contents of this site at any time. We have no obligation to update information or contents on this site. By using this site, you agree that it is your responsibility to monitor and take note of any changes which may or do occur to our site.

Credit Card information is always encrypted during transfers of any network. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of a service or the service of this website or any contact which any service is available by without explicit written permission by CRM.

We do not guarantee, represent or pledge that your use of this website or other service offered will be: without interruptions, timely, secure or error-free. We do not guarantee that the results that may be obtained from the use of the service will be accurate or reliable. 

You agree that from time to time the main service may not be running or may be removed for any amount of time without notice. You expressively agree that your ability or inability to use the service is at your own risk. The service and all products/services available in, from or as part of the service (unless stated by CRM) is in the form of "as is" and/or "as available" for your use without warranties, conditions, representations of any nature. This covers all parameters whether expressed or implied, not limited to but including: fitness for a particular purpose, merchantable quality, durability, title and non infringement. In no case whatsoever shall CRM, affiliates, directors, associates, staff, contractors, service providers, providers of license(s) or other such associated person and/or entity be liable or accountable for any injury, claim, loss, direct or indirect, incidental, special, consequential, or punitive damage of any kind. This is including without limitation: loss of profit, loss of revenue, loss of savings, loss of data, conflict of interest, replacement cost, damage to personal or private property, or anything similar as declared herein, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any product obtained or procured by way of the service or any other claim related to use of the service or any product. This includes but is not limited to: Any loss or damage (not limited to but including any sort of injury or death) of any kind incurred as a result of any use of the service or product or content available by way of the service, even if advised of the possibility. Since some states and/or designated regions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or regions/jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You may not use any of our products for illegal or unauthorized purposes nor may you, in the use of a service (this site or a product offered by CRM on this site or elsewhere) violate any laws in your jurisdiction (including but not limited to copyright laws). You must not, or attempt to, transmit any malicious software or code to this website or code of destructive nature. The same applies to what is known as "worms", "viruses" or other programs/code which falls under the designation of "Malware". CRM reserves the right to terminate your use of this service or other site at our discretion for any reason. 

Section 11 - Indemnification 

You agree to indemnify, defend and hold harmless Cardinal River Models and any other affiliated company, person, organization, group or anyone employed by CRM. You agree to hold any and all of the fore-stated harmless of any claim or demand including reasonable attorneys' fees, made by any third party due to your breach of these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions. 

Section 12 - Errors, Omissions and Inaccuracies

It may be found on the odd occasion that the site/service contains inaccuracies or faulted information or content. CRM is not liable for these occurrences and holds the right to reframe from their declaration. These errors or inaccuracies may pertain to any aspect of the site/service from shipping information/charges, to stock availability and everything else. CRM is not obligated to remedy these errors if they occur and any changes anywhere in the service are not an indication a remedy or amendment has been made. 

Section 13 - Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be construed and governed in accordance with the laws of the United States.

Section 14 - Severability Statement

 

If in an event where any part or provision of these Terms of Service is determined to be void, unenforceable or unlawful, the provision will be enforceable to the fullest extent of applicable law and the unenforceable section will be considered omitted from the relevant Terms of Service. This should not affect the enforceable Terms  found herein. 

Section 15 -  Conclusion

These Terms of Service and any policies or rules posted by CRM on this site or in respect to any Service as part of this site constitutes the entire agreement and understanding between you and CRM and govern your use of the site/service. These terms supersede any and all communications between you and CRM, regardless of format, including but not limited to any declarations, policies or terms of service.
